The man who, according to his neighbor, smashed a puppy to death against an apartment wall in Lubbock might not have broken the law. That�s right, we learn from Kathy Thompson at the Humane Society of the United States that torturing an 8-week-old Dachshund puppy to death is not always illegal in Lubbock or the rest of Texas. Thompson says, �Actually, I�m afraid that�s true. You can actually kill your own animal in the state of Texas. Or if you have the permission of the owner you can do so.� One of the web sites associated with the Humane Society says a guy down in Houston used a lawn mower on a puppy. And that�s not illegal? Thompson responds, �If it was his puppy or if it didn�t have an owner I�m afraid it may not be illegal.� Yesterday News Radio 1420 broke the story that the Humane Society of the United States has gotten involved in reports of a 22-year old Lubbock man beating his girlfriend�s puppy to death earlier this week in the Savannah Oaks Apartments. However, if this young man can prove that he was co-owner of the dog, he�s off the hook for animal cruelty. A neighbor is on the record describing how the dog died. A police report does NOT confirm the animal cruelty accusation. The police report only confirms that 22-year-old Tyson Chance Mullins was arrested on two charges: public intoxication and evading arrest. The maximum penalty for torturing a puppy to death is a Class A misdemeanor with up to one year in jail. The exception to the rule is if there�s a previous conviction for animal cruelty and then it can be a state jail felony.
