had a conversation with my lawyer for pre apl/child support hearing.

Personally, I would like to cut more than ties...at this point!!!!! ;O
( i guess she cant understand why with all my antiques in the house
being destroyed and my very house having been destroyed, and the fact
that my 18 and 21 yo (16 yo lived there til July) lived in filth
doesn't matter? and some how she equates this with breaking ties
,,,,what???)

and she stated that if this case goes to trial, she will not defend me
and I will have to defend myself because although she believes that his
offer is not enough and I should not settle for so little, that the
marital property is not enough to support the fees involved with going
to trial.

I only want what I believe is fair...mind you... i have not been
treated fairly NOT ONCE...so far and it is a matter of almost 25,000 or
more!!!! and getting my items out of there and getting compensation for
what he has destroyed.

What would you do?

how much will it cost you to get your half of that 25000? how much is your
sanity worth. how much is a good relationship with your children worth?

You have a straight-shooter for a lawyer. This is a good thing...

The choice is yours. You can go to court and incur $25K in legal fees
or settle.

Some how guys.... I should be able to at least threaten to GO ALL THE
WAY....
TO FAIRNESS... or at least a little damn closer.... he is sitting on
the house, my antiques and his dads artwork...one is worth over 12,000
alone!
I must try to get him to be fair and knowing what a miser he is,
knowing what it might cost him to fight me....he just might!

This control freak could not defend himself in court against me without
a lawyer...he is so full of lies... i don't think he can remember the
truth about his own lies!

Why? What does that get you except to continue the battle. You're are
fighting over a little money, and I would bet you that the $12,000 is
your estimation, not the market's estimation.

Rog (n case you missed it) was tongue in cheek. Your lawyer is telling
you it is not worth it.

Think about it. Let's say that the total estate is $50,000. Let's say
your lawyer bills $200 an hour. That's 250 hours, or two weeks worth of
work (you only get half). each court day will be four hours, plus the
prep time to get to court (figure 10 hours per hearing, and you'll have
three or four of those. And you get zero in that scenario. Zilch.
Nothing. Don't like $200 an hour. Do the math at $100 an hour. Comes
out the same. You'll end up paying your attorney more than you'll end
up with.

Also ... you are using your attorney as an emotional counsellor, not as
a lawyer. You want her to agree with you .. but that's not her job.
She's doing you a favour ... listen to her.

I'd look long and hard at the 'control freak' aspect. It might not be
directed where it does the best benefit.
